Adoption Credit Letter Received IRS

Well I have finally received the first letter from the IRS requesting additional documentations.  We mailed our return on about March 23rd and received our letter on May 4th.  The letter is nice form letter from the IRS saying they are examining our 2010 federal income tax return.  We need you to provide us with additional information to substantiate the items checked below that you claimed on your return.

*Tax Credits
*Adoption Credit

They wanted the following info:
Part A-Verification of Adoption
If the adoption is final, provide one of the following:
Foreign adoption from a country tht is not part to the Hague Convention:
*Transalated decree of adoption from a foreign court or other document, issued by the competent authority establishing that a parent-child relationship has been created or
*IR 2 or IR-3 Visa
Please note we provided this information when we initially filed the return and also this just applies to foreign adoptions.  There are other requirements for domestic adoptions.

Part B:Verification of Qualified Expenses:
In order to verify your qualified adoption expenses, please provide a written statement describing each expense.  Also include copies of cancelled checks and receipts.  Qualified adoption expenses may include.
*Court Fees
*Attorney Fees
*Travel expenses, including meals and lodging while away from home
*Re-adoption expenses relating to the adoption of a foreign child.

For our youngest son Caleb our adoption agency gave us a printout that had most of the expenses to the maximum credit listed, so we just need to find the information for oldest son Joey.  On Monday May 9th my wife called the adoption agency and requested a printout on Joey and with the influx of calls about the credit they revised there letters in the database for all adoptions they have handles.  They emailed us a copy of both Joey and Caleb’s letter listing all expenses paid directly though CCAI which is our adoption agency.  These letters covered all, but between $500 and $1,000, so I had a little more research to do.

My first step was to round up all the receipts I had, and most receipts were actually on Joey for some reason.

It made it somewhat easy for me to track down the expenses as I keep our personal financial records on QuickBooks I knew the exact dates and how paid.  I used this as my itemized list.

My next step is I went to our bank online and printed off all canceled checks that we used for the adoptions, which that would cover everything.

I didn’t do anything with the credit card receipts as of yet, because we don’t need that much substantiation.

I put the packets together for each adoption in order and faxed the documentation over to the fax number on notice as I figured that was quicker than snail mail.

Tax-Exempt Organizations for 990 Due May 16, 2011

Form 990 for calendar year tax-exempt organizqations are due May 16, 2011.  You can however use form 8868 to apply for an automatic 3 month extension.   You can get more information at this link http://www.irs.gov/pub/irs-pdf/f8868.pdf

Organizations that have gross receipts for 2010 of less than $200,000 and total assets less than $500,000 can file form 990-EZ.  Many small tax exempt organizations with annual gross receipts less than or equal to $50,000 now must submit Form 990-N.  If you do not file your 990-N for three consecutive years you will automatically lose your tax-exempt status.

My 19th Tax Season behind me

Well another tax season is behind me.  Overall I think it was an excellent tax season.  We have come a long ways since my first tax season.  The Next Generation of Technology really helps streamline our production and allows us to be more efficient in the logn run.  Some of the technologies that we use are the folling:

  • We deliver most returns via electronic means through a portal on our website, clients can retrieve there past tax returns, W-2’s etc.  I would say we have about 90% electronic delivery rate for all clients.
  • Almost all our business clients are on our QuickBooks Hosted service, which allow 24/7 access to their Quickbooks data as well as allowing us to access their file at the same time.  It also provides for automatic backups of their QuickBooks files.
  • All of our internal software including tax software on a remote server and this year we have totally eliminated our server, so our clients and our firm data is backed up daily and we can log in from anywhere with internet access.

Using these technologies has allowed me to go home for dinner, coach the boys soccer teams and after they went to bed, do some more work from home.  Some mornings I even got up early when my wife went to workout and did some work before I went and did my workout.

Claiming Adoption Credit Requires Paper File Form 8839

If you have not discovered yet, that if you are claiming the adoption credit for 2010 that you will have to paper file and not electronically file.  I will be doing just that for my own tax return.  Can’t remember last time I paper filed.

You will need to attach the following information to your paper filed return to receive the credit either against tax or refundable.  You must provide at least one of the following documents and attach it to your Form 8839 and file with your tax return:

Domestic adoptions that have not been finalized in 2010 or earlier, you will need to attach one or more of the following:

1.      An adoption taxpayer identification number, obtained by the taxpayer for the child, included on the taxpayer’s income tax return(instead of attaching a document).

2.      A home study completed by an authorized placement agency.

3.      A placement agreement with an authorized placement agency.

4.      A document signed by a hospital official authorizing the release of a newborn child from the hospital to the taxpayer for legal adoption.

5.      A court document (a copy showing official seal), ordering or approving the placement of a child with the taxpayer for legal adoption.

6.      An original affidavit or notarized statement signed under penalties of perjury from an adoption attorney, government official, or other authorized person, stating that the signer:

a.       Placed or is placing a child with the taxpayer for legal adoption.

b.      Is facilitating the adoption process for the taxpayer in an official capacity, with a description of the actions taken to facilitate the process.

 

Domestic and foreign adoptions that have been finalized:

1.      For a domestic or foreign adoption finalized in the United States, the adoption order or decree.

2.      For an adoption governed by the Hague Convention and finalized in another country.

a.       The Hague Adoption Certificate(immigrating Child)

b.      The IH-3 visa or

c.       A foreign adoption decree translated into English.

3.      For a foreign adoption from a country that is not party to the Hague Convention.

a.       A foreign adoption decree translated into English.

b.      An IR-2 or IR-3 visa.

IRS Not Mailing 2011 Tax Forms

In effort to encourage more people to file electronically and to save money, the IRS has decided not to mail out tax forms this year.  Some people are having a hard time finding any forms anywhere if they do not have an internet connection.

The IRS says about 70% of tax forms are filed electronically now.  So this will not affect most people.  There is however elderly people with out a computer.

We were looking for some old 1099-Misc. forms for 2009 as we have client under audit that needed to file some old forms.  We went to the local IRS office and they told us, the only place you can get forms now is at the downtown branch, which is kind of inconvenient to say the least.

If you need paper forms still, you can do any of the following:

1.      Go to www.irs.gov and download the forms you need.

2.      You can make a trip to one of Taxpayer Assistance Centers.  Here is a list of centers in Colorado.

a.       2864 S. Circle Drive, Colorado Springs

b.      1999 Broadway, Denver

c.       301 S. Howes St., Fort Collins

d.      561 25 Road, Grand Junction

3.      If you just want the forms mailed to you, you can call 1-800-829-3676.  Allow at least 10 days if the forms are in stock, if not expect to wait longer.

To solve all the issues we really recommend electronically filing your return for the following reasons.

1.      There are fewer errors.

2.      Faster refunds.

3.      Immediate confirmation that IRS accepted your return.

Important Dates

A quick reminder that Corporate and Partnership Tax Returns are due on September 15, 2010 and Estimated Tax Payments are due that day as well.  Have you had your returns completed yet?

Adoptive Parents Need This Information

The Health Care Legislation is enough to boggle the mind…However, here is a bit of good news for those of us that are adoptive parents.  For 2010, adoptive parents may qualify to claim credit against their federal taxes up to $13,170 for “qualified adoption expenses” for each adopted child.  Not only did they increase the amount, they also made it refundable!  Previously the credit was non-refundable so parent could only use the credit to reduce their federal tax to zero and then carry over the balance  for up to 5 years.

So, if your family has already adopted like ours and you have credit carry overs you will be able to use the credits on your 2010 federal taxes to reduce them to zero and any remaining credit will be refundable.  I will use our family as an example, we adopted our first child in 2006 and our second in 2008.  We qualified for the full tax credit for both.  As of 2009 we were using up the last of our tax credits from our first adoption and using tax credits from our second adoption for any federal taxes owed.  The difference when we file our 2010 taxes is once we have used adoption credits to reduce our taxes owed on federal to zero any remaining credit will be coming back to us in a refund.

This is great news for families that have already adopted that have been carrying a credit and for families adopting in 2010 or 2011 will also benefit from the refundable provision.  So, if you have adopted and have unused credits or are in the process of adopting please talk to your tax adviser to see how this new provision will effect you.  You may also contact us at knollcpa.com

HIRE Act, what you need to know!

March 18, 2010 President Obama signed into law the Hiring Incentives to Restore Employment Act (HIRE).  This is a plan to create jobs by providing a temporary tax break to companies that hire the unemployed.  So,  how does this benefit you the employer?  This will exempt you the employer from paying the employer portion of the Social Security taxes for the remainder of the year on new hires who were previously unemployed.

A qualified employee meets the following requirements:

  • Begins employment after February 3, 2010, but before January 1, 2011.
  • Has not been employed more than 40 hours total during the previous 60 days.  The employee must sign an affidavit attesting that this is true.
  • Employee is not hired to replace an existing employee UNLESS the prior employee left voluntarily or for cause.  In other words you can not replace an employee that you laid off.
  • Employee is NOT a family member of the business owner.

Employers may begin  claiming this tax credit on the second quarter 2010 Form 941.  The tax credit is for the 6.2% employer portion of the Social Security tax for wages paid to qualified employees up to the $106,800 Social Security wage base.

Where is my tax refund?!?

Where’s My Refund? You can track your federal refund through this interactive tool at irs.gov 24 hours a day seven days a week.  Information is available 72 hours after the IRS confirms receipt of your e-filed return or three to four weeks after mailing in your paper return.  You want to have your return handy to provide your social security number, your filing status and your refund amount.  After entering this information you will be provided the date the refund was deposited or a check mailed to you, or acknowledgment that return has been received and is in process .  If there is a problem with your return or an incorrect address the system will guide you to your next steps.

Tracking Business Mileage

Do you scramble at the end of every year trying to figure out your mileage to claim on your business taxes? If you have a hard time keeping track of this important deduction here are a few tips we have received from our clients. If you don’t have a mileage log in your car just throw a small notebook in your glove box to keep track. Do you use a smart phone or Palm pilot to keep track of your appointments. Why not put a notation right on your appointment information of the distance to your appointment. You can easily look up this information online through Map Quest or Yahoo Maps. Did you know you can usually turn your mileage in to your accountant or bookkeeper monthly to avoid any last minute scrambling and trying to remember what part of your mileage was business or personal? Your mileage can really add up over time and is worth taking the little bit of extra time each month to make sure you have it all documented.
